Acceptance of Terms

By accessing or using this service, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

Description of Service

GiftMaker.ai creates personalized gifts from your photos, words and AI artwork, with digital downloads, shareable gift pages and physical prints. Physical purchases include the design’s digital unlock; digital access is also available separately. AI results can vary; review the previews before buying. We may modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach.

Acceptable Use

You agree not to:

• Violate any applicable laws or regulations.
• Infringe on the intellectual property or other rights of any party.
• Attempt to gain unauthorized access to our systems or data.
• Interfere with or disrupt the integrity or performance of the service.
• Use the service to send spam, malware, or other harmful content.

Payment and Billing

Credit packs are one-time purchases, valid for 365 days. A guest can try one generation; an email-verified account includes up to three free generations in total, including the guest preview, subject to shared-network and daily service-capacity limits. Additional generations cost 5 credits. Unlocking the available original-resolution versions of one artwork costs 50 credits. Physical gift purchases from your Studio artwork include the digital unlock for that design after payment is confirmed, with no additional unlock credits. Buying a digital unlock on its own does not include a physical gift. The checkout shows the amount payable.

Each artwork includes one free retry, plus one more after unlocking. A successful retry replaces the current versions; download any unlocked images you want to keep first. Existing print orders retain the image and message captured when the order was placed.

Intellectual Property

The service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Termination

We may suspend or terminate your access to the service at any time if you violate these terms. You may request account closure by emailing support@giftmaker.ai.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the service.

Changes to These Terms

We may modify these Terms at any time. We will notify users of any material changes by updating the date at the top of this page and, where appropriate, sending a notice through the service.

Your uploads and AI designs

Only upload content you own or are authorized to use. Get permission from other people shown in a photo and from a parent or guardian before uploading a child's photo. Do not upload sensitive documents or private content that others have not agreed to share.

You retain your rights to the content you upload. You permit us and the service providers needed for your order to process, store, transform and print it to provide the features you request. Creating a gift link makes its selected artwork and message accessible to anyone with that link.

AI can change details, produce inaccuracies or produce results similar to other outputs. We do not promise exclusive rights or copyright protection for AI-generated content. Review the design before sharing or ordering it. Do not use the service for sexual exploitation, nonconsensual intimate imagery, deceptive impersonation, harassment, hateful content, illegal material or infringement of another party's rights.

Report a content or intellectual-property concern through our contact page, including the URL and an explanation of your rights or concern. Nothing in these terms excludes consumer rights that cannot lawfully be excluded.
